You should know that the Court is prohibited by law from responding to requests for legal advice. All such requests should be made directly with a licensed attorney. Further, documents received as attachments via the Circuit Clerk’s e-mail are not a valid means of filing with the Court. All pleadings and documents must be filed with the Circuit Clerk’s Office pursuant to the requirements of the law.

DADE COUNTY JURY INFORMATION

Overview

Jurors are selected by computer randomization from Voter Registration and Department of Revenue records and sent a summons approximately four weeks prior to the date they are to report. In order to minimize the amount of time juror’s lives are disrupted, jurors are instructed to call the Circuit Clerk’s office the day before their report date to assure that there has been no change in their reporting instructions. Sometimes the trial gets canceled.

The Summons

Log into https://missouri.clearviewjustice.com/ on a computer, tablet, or smartphone and complete the online qualification form and questionnaire within 10 days of receiving your summons.


If you are requesting a disqualification or excusal due to mental health or medical reasons you MUST upload a doctor’s note at least 2 weeks before your report date.  Requests that do not have an associated doctor’s note will be denied.


Documents supporting a request for disqualification or excusal may uploaded from a computer file or from the camera of a tablet or smartphone.


Bring the bottom portion of the summons when you report for jury duty.


Reporting For Jury Duty

Report time is 8:30 a.m.


Report to the Dade County Courthouse located at 300 W. Water St, Greenfield, MO 65661. Security screening is conducted on all persons entering the Courthouse. Be prepared to remove watches, jewelry, belts and/ or any other items that may trigger screening devices. Individuals carrying prohibited items will be required to dispose of them before entering the building. Prohibited items include, but are not limited to: 


  • any firearm or other weapon
  • any sharp objects such as metal utensils, knitting needles, scissors tools or knives of any sort
  • flammable chemicals including hair spray, pepper spray or mace
  • cigarette lighters.



FREQUENTLY ASKED QUESTIONS AND ITEMS OF INTEREST

  • How was I selected for jury service?

    Jurors are selected by computer randomization of names from a minimum of two government records including, but not limited to, personal property tax list, voters registration list, and drivers license records.

  • What constitutes jury service?

    There are two ways to complete jury service.  The first is to appear in person and serve until you are released, regardless of whether or not you were selected as a juror for a case.  The second is to be summoned and have your service cancelled by the Court.  To find out if your current service has been canceled call the office at 417-637-2741 the day before your report date.

  • How long should I expect to serve on jury duty?

    On the day you are to report, please plan on being at the courthouse the entire day, occasionally after 5:00 p.m.  The jury selection process is usually completed in one day.  Most jurors go through only one selection process and those not selected for the jury panel are released at the end of the selection.

  • Where and when do I report?

    Report to the 1st Floor of the Dade County Courthouse located at 300 W. Water St, 
Greenfield, Mo 65661. Your specific report date and time are printed on the lower left front of your Juror Summons.  To verify your report date and time call the 417-637-2741 the day before your scheduled report date.  Report time is 8:30 a.m.

  • What happens if I fail to appear for jury service?

    A person who willfully fails to appear for jury service is in civil contempt of court.  The Court may issue an order directing the person to a hearing where the person would be required to show good cause for failure to appear as summoned.  If the individual fails to show good cause for failing to appear, the Court may impose a fine for as much as $500 and may order the prospective juror to perform community service for a time no less than would have been spent in jury service.  The juror is also re-summoned for jury service.

  • How should I dress for jury service?

    Appropriate dress is required.  Think business casual.   Jeans are allowed but shorts, tank tops, and tee-shirts are not considered appropriate.  Hats are not allowed in the courtroom. Temperatures in the building vary and it is recommended that you bring a sweater or jacket with you.

  • Cell phones, laptops and electronic equipment: are they allowed?

    Yes, cell phones are allowed to be brought into the courthouses.  However, they must be turned to silent or vibrate while you are in the jury assembly room and courtroom.  Laptops and other electronic devices are not allowed.

  • I completed jury service within the last 24 months; do I need to serve again?

    No.  If you completed Dade County jury service in the last 24 months you are entitled to be excused.  Log into the Show-Me Jury eJuror website at www.courts.mo.gov/ejuror, complete the qualification form and questionnaire, and select Excuse Code “Served within Last 24 Months.”  If you served under a different name or different address please enter that information.  If you would like to serve again you are free to do so by not selecting the Excuse option.

  • I received a jury summons for a deceased family member.  What should I do?

    Log onto the Show-Me Jury eJuror website at www.courts.mo.gov/ejuror.  Using the nine digit ID on the summons log into the qualification form and affirm that the summoned individual is deceased.

  • I don’t live in Dade County do I still have to appear for jury service?

    Only current residents of Dade County are eligible for jury service.  If you do not live in Dade County log into Show-Me Jury eJuror at www.courts.mo.gov/ejuror, complete the qualification form and questionnaire, being sure to update your name and address information.  If you enter an email address or cell phone number we will notify you of your disqualification.  DO NOT appear for jury service.

  • Reporting for jury service would cause a financial hardship for me, my family, or my business.  Can I be excused?

    Because of the importance of assuring that individuals from throughout the community participate in the jury process, the Court generally does not excuse individuals based on financial hardship at the initial summons stage of the process.  Instead, hardships are discussed during jury selection for a trial.  If you believe your circumstances fall within the provisions contained in Missouri Revised Statute 494.430 you need to request an excuse on the Show-Me Jury eJuror website at www.courts.mo.gov/ejuror.  Be specific and provide information such as business name and type, financial, medical, and/or other proof regarding your hardship.

  • I am a nursing mother.  Can I be excused?

    Any nursing mother, upon her request, and with a completed written statement from her physician to the court certifying she is a nursing mother will be excused.

  • I am a stay-at-home parent with children that are not yet in school or the caregiver to a disabled person.  Can I be excused?

    The Court generally does not excuse individuals based on physical or financial hardship at the initial summons stage of the process.  Instead, hardships are discussed during jury selection for a trial.  If you believe your circumstances fall within the provisions contained in Missouri Revised Statute 494.430 you may request an excuse in writing on the Juror Qualification Form.  Be specific and provide information such as financial, medical, and/or other proof regarding your hardship.

  • HOW TO PAY

    By Phone, Mail, this Website, or in Person

    Acceptable forms of payment are cash, check, cashier's check, money order, debit card, and credit card. If mailing, make your payment out to the Dade County Circuit Clerk and send to 300 W. Water, Greenfield, MO, 65661. You may pay in person at the same location. If paying by phone, call 417-637-2741. Business hours are Monday-Friday 7:30 a.m. to 4:00 p.m. (except holidays).

  • PAYING WITH A CARD IN PERSON OR OVER THE PHONE

    Debit or Credit Card

    You may pay with a debit or credit card (American Express, Discover, MasterCard, or Visa). There is a third party convenience fee collected by our credit card vendor. The Dade County Circuit Clerk's Office does not receive any of these fees. Please note: If paying by phone, credit/debit card must be in the defendant's name.

  • PAY BY WEB

    If paying by web, you will be directed to the State of Missouri Judicial Payments System. Higher third party convenience fees may apply. The Dade County Circuit Clerk's Office does not receive any of these fees.

  • PLEAD OR PAY TRAFFIC TICKETS

    If are wanting to pay your traffic ticket, You may access Case.net and search by litigant name. First, select the 28th Judicial Circuit from the field titled "Search For Cases In" and enter your name as shown on your ticket then click "Find". Click on your case #, once that page opens up you will find Plead And Pay .  You may pay your ticket up to the day of court. If you cannot locate your case, please contact our office at 417-637-2741. If you do not have access to Case.net, please feel free to call our office at the above number. The Dade County Circuit Clerk's Office does not receive any of these fees.

How To...

  • PAY CHILD SUPPORT

    TO THE FAMILY SUPPORT PAYMENT CENTER

    You may pay online at:  https://mo.smartchildsupport.com. You can mail your payments to them at: FSPC, P.O. Box 109002, Jefferson City, MO 65110-9002.


    The Circuit Clerk’s Office does not process payments for child support or maintenance.


    NON-CUSTODIAL PARENT

    You may pay by the following methods: Personal check, cashier check or money order (by mail); credit/debit card (online and by phone). Always be sure to include your court order number and/or your MACSS ID number (A unique number assigned by the Family Support Division) to ensure your payment is posted correctly). You will not receive a receipt, so it is up to you to keep records of your transactions. If paying by mail, be sure your name and return address are legible.


    CUSTODIAL PARENT

    Please note that the FSPC does not issue checks.  They will issue a “SmiOne Card” (similar to a debit card) and load the payments onto it as they are received or they can electronically deposit the payments into your bank account.  For more information regarding these options, please call the FSPC Payment Processing at 1-888-761-3665. 


    If you need pay information, please call the automated system at 1-800-225-0530.  You will have access to the last three payments. You may also visit https://dss.mo.gov/child-support/ to view and print the last 13 months of payments.  You must have your MACSS ID Number to access the online and automated systems.


    If Child Support Enforcement is involved in your case, they can be reached at 1-866-313-9960. This is the Customer Service line and it will be answered by an actual person.

  • TERMINATE OR MODIFY CHILD SUPPORT

    When the child support is from an Administrative Order:

    Contact the Division of Child Support Enforcement (DCSE) at 1-866-313-9960.


    When the child support was court-ordered and the child is a qualifying 18 year old (or older):

    Print out and fill out an Affidavit of Termination of Child Support found here. 

    • IF YOU RECEIVE THE CHILD SUPPORT, submit the form with your photo ID to the Circuit Clerk's office.
    • IF YOU PAY THE CHILD SUPPORT, submit the form with your photo ID and a service fee payment for Sheriff's service. 

    When the child reaches the age of 21: 

    Child Support will automatically terminate with no action by the parties being necessary. 

      

    For other situations:

    The filing fee is $105.50 plus service fee to be applied.

  • FORGIVE ARREARS (CHILD SUPPORT OR MAINTENANCE)

    Only the person who is receiving child support or maintenance may file. Fill out the Affidavit of Credit form found here. Include on the form the money amount to be forgiven whether it be for a partial or complete satisfaction. You can forgive a past owed amount, but not current or future amounts. Submit the form in person to the Circuit Clerk's office along with your photo ID.

  • WITHHOLD PAYMENT FROM INCOME

    Fill out the Income Withholding for Support form here with filing instructions being found here. The monthly arrears that can be withheld may not exceed 50% of the monthly child support or maintenance amount. Submit the completed form to the Circuit Clerk's office.

    To Request in Person

    Copies can be provided in person for .25 cents per page ($5.00 extra for each certified document). Some documents will require you to show your photo ID in order to receive copies.  


    To Request by Mail

    Complete the Request for Record/Copy form and a copy of your photo ID. For each document, the copy fee is $3 for a non-certified copy and $5 for a certified copy plus additional .25 cents per page for copies fees. There is a postage charge rate set United States Postal Service. You will be contacted by phone with payment instructions. Send your request to:

  • AUDIO RECORDING AND TRANSCRIPT REQUESTS

    Please note that not all cases will have an audio recording or transcript as this varies due to different case types. These requests require more time for process than paper copies. Processing times and cost will vary. Also, some case types require you to be a party to the case to be eligible to receive an audio recording or transcript. For more information please call our office.


    Request forms may be filed in person, by mail, fax, or email. If you are mailing, faxing, or emailing be sure to include a copy of your photo ID. Payments may be made by cash, money order/cashier’s check or by debit/credit card over the phone. A third party convenience fee does apply if using a debit/credit card.

    CD’s are $50.00 


    Two Types of Transcripts:

    1. Transcript of an audio recorded Associate Court or Domestic/Family Court hearing or case: Our office has to send these requests to Jefferson City, MO for processing. Payment will be due prior to request being sent.
    2. Circuit Court Transcripts prepared by the Court Reporter: These requests will be forwarded to the correct Court Reporter. The Court Reporter will let you know how long it will take to process your request and the cost of the transcript. The fees for the transcripts prepared by the Court Reporter are paid directly to the Court Reporter and not to the Clerk’s Office.

File a Small Claim

Missouri small claims court allows businesses or people to file lawsuits of up to $5,000 without hiring an Attorney. Before you file suit in small claims court, make sure there is no other way of settling your dispute. You may save yourself a lot of time and effort. You may file no more than twelve claims in small claims court in any calendar year.

  • HOW SMALL CLAIMS LAWSUITS ARE FILED

    The plaintiff (the one who files the lawsuit) usually submits the legal documents in the associate circuit court where the person or business you are suing is located or where the product or service was bought. 


    The filing fee is $83.50. There is also a service fee - the amount of which depends on how you choose to serve them. For sheriff's service in another county, contact that department to see how much their service fee is.


    Once the lawsuit is filed, a hearing date is scheduled

  • WHAT HAPPENS IN COURT

    When the court date arrives, you will tell your side of the story to the Judge. You can call witnesses or use any additional information to explain your case. The defendant (the party being sued) also explains his side of the story to the Judge. Do not be intimidated if the defendant is represented by an attorney. The Judge has a responsibility to ensure the proceedings remain informal so your lack of legal knowledge will not hinder you. The Judge then questions all parties associated with the case before making a final decision. 

  • HOW TO PREPARE YOUR SMALL CLAIMS LAWSUIT

    1. Organize relevant materials such as bills, receipts and letters so you can make a complete and orderly presentation at the hearing.
    2. Prepare a full, but brief statement of the facts in your case.
    3. Determine what witnesses, if any, you want to testify. Reluctant witnesses may be subpoenaed if they are important.  
    4. Check Case.net or contact the court before the hearing to find out if the defendant has been served with the summons. If service has not been made, the clerk can tell you your options.
    5. Be on time for the hearing. Failure to do so may result in dismissal of your lawsuit.

  • COURT OFFICIALS DO NOT COLLECT MONEY ASSOCIATED WITH THE JUDGE'S RULING

    If you have trouble recouping money awarded in small claims court, you have additional legal remedies under the law
.


    The losing party in small claims court also can file an application for a new trial, which will be heard in circuit court. (You usually will need a lawyer's help.) Those applications must be filed in small claims court within 10 days after the Judge's order or the losing party in the case is liable for costs associated with the judgment.

Below are a few frequently asked questions with generalized answers about ex-parte protection orders. More detailed information about adult abuse/stalking protection orders is available here or you may read Chapter 455, RSMo. More detailed information about orders of child protection is available here or you may read Sections 455.500 through 455.538, RSMo.

  • WHAT IS AN EX-PARTE PROTECTION ORDER?

    An ex-parte is a temporary protection order granted to the petitioner which is valid in every US state and upheld by law enforcement until a court hearing which will be set within 15 days of the original file date. The ex-parte bars an abuser from committing domestic violence or stalking the petitioner, enter the home, work or school of the petitioner and communicating with the petitioner through any medium.

  • WHO CAN FILE FOR AN EX-PARTE PROTECTION ORDER?

    Any person over the age of 17, or otherwise emancipated, who has been a victim of abuse by a present or past family or household member or a significant or intimate partner OR who has been a victim of stalking or sexual assault may seek relief. A parent, guardian or court-appointed special advocate may apply for protection for anyone under the age of 17.

  • WHERE CAN I GET THE PAPERWORK TO FILE FOR AN EX-PARTE PROTECTION ORDER?

    You may obtain the paperwork in the Circuit Clerk's office. Alternatively, you may find the adult form here, the form to protect one child here, and the form to protect up to five children here.


    Where can I file an ex parte protection order?

  • HOW MUCH DOES IT COST TO FILE FOR AN EX-PARTE PROTECTION ORDER?

    There is no filing fee to file for an ex-parte protection order.

  • WHAT IS THE PROCESS FOR GETTING AN EX-PARTE PROTECTION ORDER ISSUED?

    Once your paperwork is filled out and there is a good address for the person to be served then paperwork can be turned in to the Circuit Clerk's office, a judge will review your request. If your request is approved, you must return and pick up a copy of your order. You will then have to appear at a hearing for a full protection order at a later date.
